Terms of Service
This is the Terms of Service for the baobears group and closed species.
- You're always welcome to ask miyabau if you have any questions or require clarification for any of these rules!
- By purchasing, trading, or otherwise receiving a baobear, you automatically agree to these terms.
- Repeatedly breaking the TOS or committing any major violations will lead to blacklisting and any applicable designs and in-game items being voided.
- For baobears not made by miyabau, please remember to follow and respect the appropriate artist's TOS!
- All users must be at least 13 years or older to participate in the group.
- Users must be at least 18 years or older to make monetary purchases in the group.
- Please be kind, courteous, and considerate to your fellow users.
- Any user found to be harrassing, scamming, stealing from, or otherwise causing problems to another user, the group, or the community may be banned depending on the severity of the act.
- Users are allowed to join the baobear group and participate in group activities regardless of whether or not they own a baobear.
- Site, ARPG, and Discord participation is a privilege. It is completely optional and not mandatory when owning a baobear.
- These privileges may be revoked if a user is found to be breaking any rules or acting in a disruptive manner.
- All submissions to the group must be baobear related.
- All submissions must be your own work. We do not accept AI work.
- Baobears are babies!!! Keep things PG-13!!!!
- Any content in official spaces (site, discord, etc.) must fully sfw or it will be removed. Do not post, talk about, or even allude to topics that are NSFW or otherwise adult in nature (ex. gore, swearing, etc.).
PAYMENTS
- All payments will be taken upfront, unless otherwise discussed (ex. payment plans).
- All payments are in USD through PayPal Invoicing unless otherwise specified in the sales post/journal.
- The artist will send an invoice for payment. Please do not send any payments prior, as they will be refunded.
- Unless discussed, payments are due within 48 hours of an approved claim, offer, or winning bid. Otherwise, they will be put back up for resale.
- Artists reserve the right to refuse a service or an adopt sale to anyone at their own discretion. (ex. Users with brand new accounts without an established main account or repeat rule-breakers.)
- Chargebacks/refunds are not allowed. In the event of a chargeback, ownership over the adopt will be rescinded and you will be blacklisted from further sales.
- Designers retain partial rights to their design. This includes all copyrights, rights to the intellectual property, and the rights to distribute, reproduce, and use in their online galleries. Artists will not reuse or resell the design again for personal and commercial projects, unless the design has been traded back to them or the design has been reclaimed due to TOS violation(s).
- You may transfer the rights of a baobear or MYO slot through trading, reselling, and/or gifting. New owners must be made aware of this TOS and any ownership transfers must be noted on-site or to miyabau to be logged.
- Co-owning is not officially recognized and is discouraged. We are not responsible for any altercations or concerns that may arise from co-ownership.
- Baobears and Baobear MYO slots that are obtained for free or through events (ex. raffles, contests, etc.) are not allowed to be traded, sold, or vouchered for non-baobear adoptables, other than Lovedrops.
- They can only be gifted, or traded for another baobear / lovedrop.
- This rule is permanently bound to the respective baobear and will apply to each successive owner. This will be listed on their master list entry.
- Please inform the person you are trading with about this rule if applicable, thank you!
- Baobears MYOs, especially ones obtained for free or currency purchase (green beans, event currency, etc.), do not technically have any 'monetary' value.
- As a general rule, they are considered to have an 'original' price of the current MYO Baoberry slot value, which is $30.
- Baobears are allowed to be resold for a maximum of twice the worth of their base price, and then any additional art bought using real money on top of it.
- For example, a baobear bought for $50 with $20 of additional art may be re-sold for a maximum of 50*2 + 20 = $120.
- This is to account for additional art NOT bought with RLC (ex. art you drew, art from trades), so please don't try to take advantage of this rule. If discovered, we may ask you to refund the extra charge to the buyer, and potentially blacklist you from future sales.
- Baobears with only gift art should not be marked up.
- For baobears not made by miyabau, please remember to follow and respect the appropriate artist's TOS, especially regarding stricter rules!
- You are not allowed to edit the original artwork of a baobear to reflect new design changes unless you have permission from the original artist.
- Baobear designs are not allowed to plagiarize or otherwise closely resemble other designs if you do not have the permission to do so.
- As per standard trading etiquette: If a baobear is a "port" of another design, both need to be traded together and cannot be separated as two separate characters.
- Some design changes can be done freely without needing in-game items OR masterlist updates.
- These design changes ONLY include:
- Accessorizing, dressing-up, or otherwise making outfits for your baobear in any way
- Drawing a humanoid version of your baobear, and any subsequent changes to this humanoid design
- We do not officially keep track of human forms. However, you may use these humanoid versions in prompts so long as they look like their corresponding baobear!
- Any other change besides those two listed above is not available to be freely tampered with in compliance with ARPG participation and canonical representation.
- These design changes ONLY include:
- Major design changes must buy appropriate in-game shop items in order to officially change the baobear's design and masterlist entry. Notable design changes include, but are not limited to:
- Significant color changes to any aspect of the design
- Trait changes
- You may 'void' a baobear at any time. This is irreversible and will make the baobear permanently unofficial. The design can never again be called a baobear under any circumstances, even if ownership changes or a myo slot is purchased. If voided, the design will no longer be bound to baobear-specific rules, only the TOS of the respective artist. In order to void your baobear, please message miyabau so they may update the masterlist.
